Thank you for choosing our cabin as part of your trip to the Great Smoky Mountains! This agreement establishes all terms and conditions for the rental of our cabin. Rental Agreement ("Agreement") is made and effective date of your booking, between April and Dave Bruder, dba "Peaks & Palms Vacation Rental Group" & dba "Moonshine Cabins", and "Guest". Once you have electronically accepted the agreement, a copy will be archived in our system and emailed to you for your records.
This Agreement applies to the Guest's originally reserved dates but also applies to any other dates which may be included if the reservation is changed.
This Agreement applies to all members of the Guest's party no matter the age or affiliation.
📋REQUIREMENTS
• Guest must be 25+ years old and provide valid ID
• No 3rd-party bookings. No refunds for “no shows” or early departures.
• False reservations void the stay without refund.
💳PAYMENTS
Direct Booking at www.peaksandpalmsrentals.com or www.peaksandpalms.com
Expedia listing sites including Expedia.com and Vrbo.com
For the above booking methods - To book, your initial payment of 50% is due. The full balance for your stay is due 30 days prior to your arrival date. If payment is not received within 7 days of invoice, we will treat the failure to pay as a cancellation by you of your reservation, may rent the cabin to another person, and prior payments will be forfeited. Reservations made less than 30 days prior to check-in date require payment in full.
Airbnb listing site - Generally Airbnb requires full payment up front, but recently began approving some guests for a "Pay less upfront" or "Pay over time" option which will split into 2 or more payments.
Any stay at our cabins, independent of booking site, must be paid in full prior to check-in date.
💥DAMAGE PROTECTION / SECURITY DEPOSIT
Accidental Protection Covers up to $1,500 in accidental damage (e.g., kitchenware)
All bookings require a Security/Damage Deposit Authorization. A security deposit (amount varies by cabin) will be authorized on your credit card before your check-in date. Upon checkout, our cleaning crew enters the cabin, and provides us with a report as they prepare the cabin for the next guest. Once we review the cleaning crew report, the deposit is released.
🗓️❌CANCELLATIONS
Cancellation policies may vary on a listing service website service due to their respective system options, however this agreement establishes the formal/enforced cancellation policy.
The guest named on the rental agreement is the only person who may cancel the reservation and it must be done via the original method where the reservation was made.
• 100% (less fees*) if cancelled 60 days prior to the Check-in Date
• 50% (less fees*) if cancelled 31-59 days prior to the Check-in Date
• 0% will be refunded 30 days prior to Check-in Date
• For mandatory evacuations: unused nights will be refunded
If you are concerned about possible cancellation, we recommend obtaining cancellation/travel insurance to cover your trip.
❄️ROAD CONDITIONS
• Winter road conditions are unpredictable; four-wheel drive and/or chains are recommended in some areas.
• Roads are maintained, but safety during inclement weather is not guaranteed.
• No refunds, transportation, or towing services due to weather or road conditions.
📜MISCELLANEOUS RULES
• Guest responsible for property care, locking doors/windows, and supervising minors.
• Notify us promptly of issues. Refunds not issued for minor malfunctions or service provider outages (electricity, internet, etc)
• Do not move furniture or adjust appliance settings beyond normal ranges.
• Fireplace use: Oct–Apr only. Adults must supervise; no foreign materials.
🎥RESORT AND PROPERTY SURVEILLANCE
• Cameras are located at the resort entrance, nearby cabins, and on front porch (viewing porch and parking only). Cameras may capture video and audio.
• No cameras inside cabin or in private spaces.
• Tampering with cameras will result in immediate termination of stay without refund.
🧑🤝🧑OCCUPANCY and QUIET HOURS
• Fireflies & Moonshine 2BR Cabin: maximum of 6 total overnight guests (max 5 adults)
• Five Bears Cabin 3BR Cabin: maximum of 8 total overnight guests
• Mudpuppies & Moonshine 5BR Cabin: maximum of 12 total overnight guests (max 8 adults)
Over-occupancy is a violation of your rental agreement. It is also an insurance, and a permit violation - your stay will be terminated without refund.
• No parties or events. Resort quiet hours: 10pm–8am. Violations may result in termination of stay without refund.
🚫🐶ANIMALS, PETS, & 🚭SMOKING
• No pets or animals. Unauthorized pets: $250 remediation fee + termination of stay.
• No smoking/vaping indoors. $250 remediation fee.
🚗PARKING
• Limited to vehicles in the spots immediately in front of your cabin
• No street parking, trailers, RVs, or motor homes. HOA fines apply.
🗝️CHECK-IN / CHECK-OUT (Self-service)
• Fireflies & Moonshine (2BR): Check-in 4pm or later / Check-out 10am
• Five Bears (3BR): Check-in 4pm or later / Check-out 11am
• Mudpuppies & Moonshine (5BR): Check-in 4pm or later / Check-out 11am
• Keyless entry code provided ~2 weeks before arrival, active only during stay
• Late check-out: $75/hr.
✨AMENITIES
• WiFi + TV Streaming provided; not guaranteed. No On-Demand/Pay-Per-View purchases.
• Hot tub cleaned between stays; use at own risk. $150 cleaning fee for misuse.
• Linens, towels, starter supplies provided - not replenished during stay.
• Mountain Shadows Resort HOA pools open daily 10am - dusk, May - Sept, weather permitting.
🛡️SAFETY
• No fireworks or open flames per city code.
• Use gas grills as posted; violations may incur $500 HOA fine.
• Review fire extinguisher locations; don’t disable smoke detectors.
• At no time should minors (under the age of 18) be left at the cabin without the Guest being present.
🏊POOL & ♨️HOT TUB - All children under the age of 18 must be accompanied by an adult at all times.
• Certain health risks are associated with using the hot tub.
• Pregnant women, guests with heart conditions, high blood pressure, diabetes and children should not use the hot tub
• Please shower prior to and after use of the hot tub
• Do not wear jewelry or clothes in the hot tub, wear bathing suits
• Place cover on hot tub when not in use
• Do not sit or stand on hot tub cover
• Community pool available (open May-Sept). Use pool at own risk. NO lifeguard on duty!
🛠️🧹MAINTENANCE, CLEANING, & TRASH
• Report issues promptly: call/text 513-400-4636.
• Cleaning fee covers standard turnover; excessive mess or unwashed dishes may result in charge.
• Trash must be bagged in bins, if full call for pickup or leave inside cabin; HOA fines apply for violations.
🐞WILDLIFE & 🧳LOST ITEMS
• Expect some insects/wildlife due to mountain location. No refunds for sightings.
• We’ll attempt to return lost items but are not responsible for missing belongings.
📝LEGAL & LIABILITY
Governing Law & Jurisdiction
This Agreement shall be governed by the laws of the State of Tennessee and deemed executed in Sevier County. Any action arising from or related to this Agreement shall be brought exclusively in the courts of Sevier County, Tennessee. Guests consent to this jurisdiction and to extraterritorial service of process.
Severability
If any term of this Agreement is found invalid or unenforceable, the remaining terms shall remain in full force and effect.
Fair Housing
This Agreement complies fully with federal, state, and local Fair Housing laws without regard to race, color, religion, gender, national origin, handicap, or familial status.
Liability & Indemnification
Guest accepts full responsibility for any property damage, loss, accident, or injury arising from use of the premises or its contents. Guest agrees to inspect and use all items properly and to indemnify and hold the Owner, its officers, and employees harmless from any and all claims, including those of third parties, resulting from Guest’s use of the property or participation in any activities thereon.
